Auction purchases are different from retail purchases.
Because LANGTONS cannot always verify how auction wine has been cellared, and because older wines naturally vary over time, buyers accept certain risks when purchasing at auction.
Consumer guarantees and auction purchases
Auction wines are often older, rare, or sourced from private collections, which means they may present differently from wines purchased through the Wine Store or Client Services. Factors such as age, storage history, ullage, label condition, closure condition and natural bottle variation can affect the wine over time. As a result, some consumer guarantees under Australian Consumer Law may apply differently to auction goods, including, in some circumstances, guarantees relating to acceptable quality or fitness for purpose. Buyers should read the lot description carefully before bidding.
When a claim may be considered
If you notify LANGTONS in writing within 28 days of delivery that the goods are materially different from their description, we will review the matter carefully.
If, following review, LANGTONS is reasonably satisfied that a listing error has occurred, we may, at our discretion and depending on the circumstances:
- replace the goods
- provide a voucher, or
- refund the amount paid
Please note that each claim is considered on its individual merits. An outcome provided in one case should not be taken as a guarantee of the same outcome in another.
Older wines
These undertakings generally do not apply to wines older than 15 years where the issue is attributable to age.
If you believe your purchase was materially misdescribed or is otherwise eligible for review, please call us on 1300 946 347.
